BIMS collects personal data and anonymous data through various different means from User(s) of our Site and/or Service.
One purpose of posting data to BIMS ecosystem is to create an environment for Asset Owners to share data and information with other Asset and service providers. Please be aware that any information that the User submits to BIMS, whether through communication by way of BIMS’s Site, social media platforms, other forms, or e-mail, including personally identifiable information, may be publicly displayed on the BIMS’s Applications, BIMS’s website, or on Applications within or not within our control. If a User does not want others to see such information, please do not submit it and User should not have any expectation of privacy with respect to any data they submit when using BIMS’s Service. We may publicly display the IP addresses of visitors and contributors to the BIMS’s Applications, BIMS’s website, and/or any of BIMS’s other social media platforms. BIMS may also use User IP address to help diagnose problems with our server, to tailor any of BIMS’s content and to format any of BIMS’s Applications to User needs, and to generate aggregate statistical reports. BIMS may use aggregate visitor data to prepare publicly displayed reports regarding the traffic on BIMS Applications, site popularity rankings, or any other information discernable from the User’s interactions with BIMS’s Applications or Site.
We may also use “cookie technology” to enhance your experience in using our Site and/or Service. A cookie is a small text file that is stored on a User’s computer for record keeping purposes.
Notwithstanding the foregoing, you agree that BIMS may periodically send you email to the email address you signed up with for various items such as suggested content, recommendations, reminders, newsletters, promotions, and other notices about the system and your content in the system.
Copyright and Trademark Infringement.
BIMS may, in appropriate circumstances and at our discretion, terminate service and/or access to the Site for you who infringe the intellectual property rights of others. If you believe that your work is the subject of copyright infringement and/or trademark infringement and appears on our Sites, please provide BIMS’s designated agent the following information required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. §512 (“DMCA”): (i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (ii) Identification of the copyrighted and/or trademarked work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works at that site; (iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled at the Sites, and information reasonably sufficient to permit BIMS to locate the material (iv) Information reasonably sufficient to permit BIMS to contact you as the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted; (v) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright and/or trademark owner, its agent, or the law; (vi) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
